Thompson, F.2d (6th Cir. 1982).*fn1 The judges of this court then voted in favor of rehearing en banc. Rule 14, Rules of the Sixth Circuit provides: "The effect of the granting of a hearing en banc shall be to vacate the previous opinion and judgment of this court, to stay the mandate and to restore the case on the docket as a pending appeal." Following supplemental briefing the appeal was argued orally to the full bench and submitted for decision.
