the trial court's order upholding the decision of the Board of
Education (Board) of Unified School District No. 440 in Harvey
County to nonrenew his employment contact. Before discussing the case on the merits, let us examine the
issue of whether the trial court had jurisdiction of this case.
To do this we must review the procedural facts in detail.
Pursuant to K.S.A. 72-5443(c), the Board mailed Butler notice of
its final decision to nonrenew on May 20, 1987; he received the
notice that day. On June 5, 1987, Butler's attorney mailed a
notice of appeal to the district court to the Board's attorney,
along with a praecipe that summons be issued to the clerk of the
Board of Education. Notice of appeal was mailed to the clerk of
the district court on June 8, 1987, along with a check covering
the filing fee issued by the Kansas National Education
Association (KNEA).
